I. GENERAL PROVISIONS

  1. The online gallery located at www.artlidia.pl is maintained by Lidia Zdzieszyńska, address for service: ul. Waszyngtona 98 m.63, 04-015 Warszawa, email address: lidiazdz@gmail.com, phone number: 604 960 772

  2. These Terms and Conditions shall govern all use of the www.artlidia.pl Gallery by all users.

  3. The Terms and Conditions stated herein set forth: the type, scope and conditions of rendering electronic services through the Gallery’s website; the conditions of concluding and terminating electronic services agreements as well as complaints procedure.

  4. By using the Electronic Services offered through the Gallery the Customer agrees to be legally bound and to abide by these Terms and Conditions.

  5. Customers are required to read and acknowledge these Terms and Conditions before using the Electronic Services offered through the website www.artlidia.pl.

  6. To all matters not settled herein the following provisions of Polish law shall apply: Act on Rendering Electronic Services of 18 July, 2002 (Dz. U. [Journal of Laws] No. 144, item 1204, as amended); provisions of the Civil Code Act of 23 April, 1964 (Dz. U. No. 16, item 93, as amended) and all other applicable provisions of Polish law.

 

II. DEFINITIONS

  1. TERMS AND CONDITIONS – shall mean collectively, the Terms and Conditions contained herein.

  2. GALLERY – shall mean the Service Provider’s website located at www.artlidia.pl

  3. SERVICE PROVIDER – shall refer to Lidia Zdzieszyńska, address for service: ul. Waszyngtona 98 m.63, 04-015 Warszawa, email address: lidiazdz@gmail.com

  4. CUSTOMER – shall mean a natural person, a corporate or non-corporate entity granted legal capacity under imperative provisions of law, using the Electronic Services.

  5. ARTWORK – shall mean any portable object created by Lidia Zdzieszyńska.

  6. ELECTRONIC SERVICE – shall mean the services provided electronically by the Service Provider via the Gallery website.

  7. REGISTRATION FORM – shall mean the electronic form available at www.artlidia.pl required for Account registration.

  8. ACCOUNT – shall mean the assigned individual username (login name) and password providing access to an organised collection of digital content stored on the Service Provider’s ICT-System.

  9. ORDER – shall mean the Customer’s declaration of intent to enter into an agreement for the creation and purchase of a work of art.

  10. NEWSLETTER – shall mean the free e-mail information service available by subscription and allowing Customers to receive updates on Artworks available through the online Gallery.

 

III. TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider grants access to the following Electronic Services:

    1. Account Management

    2. Order placement

    3. Newsletter

  2. These Terms and Conditions shall apply to all Electronic Services provided through the Gallery website.

  3. The Service Provider reserves the right to display advertising content on the website www.artlidia.com. Advertisements are an integral part of the Gallery and the materials presented therein.

 

IV. CONDITIONS OF PROVIDING SERVICES AND CONCLUDING ELECTRONIC SERVICES AGREEMENTS

  1. The Electronic Services set forth in chapter III point 1 of these Terms and Conditions are free of charge

  2. Term of the agreement:

    1. The Electronic Services agreement relating to the Account management service is concluded for an indefinite period of time.

    2. The Electronic Services agreement enabling order placement is concluded for a definite period of time and terminates upon placement or withdrawal of the Order.

    3. The Electronic Services agreement for the provision of a Newsletter is concluded for an indefinite period of time.

  3. Hardware, network and software requirements for the ICT system used by the Service Provider:

    1. a computer with an active Internet connection,

    2. email account,

    3. Internet browser,

    4. enabling cookies and Javascript in the web browser.

  4. The Customer agrees to use the Gallery website in accordance with the principles of good practice, only for lawful purposes and in a manner which does not infringe the personal rights and intellectual property rights of any third party.

  5. The Customer is obliged to provide accurate and complete information to the Service Provider.

  6. The Customer is prohibited from providing any unlawful or illegal content.

 

V. CONDITIONS OF TERMINATING ELECTRONIC SERVICES AGREEMNTS

  1. Terminating an Electronic Services agreement:

    1. Both indefinite-term Electronic Services agreements (such as Account management) and continuing Electronic Services agreements may be terminated.

    2. The Customer may terminate the agreement for convenience and with immediate effect by sending an appropriate statement to the following email address: lidiazdz@gmail.com

    3. The Service Provider reserves the right to terminate continuing and indefinite-term Electronic Services agreements in the event that the Customer violates any obligation deriving from these Terms and Conditions. This applies particularly to Customers who provide illegal content and continue to do so despite receiving a cease and desist letter from the Service Provider. The termination shall be effected within 7 days of serving an advance notice in writing (agreement termination period).

    4. The notice of termination leads to a cessation of legal relations with the effect for the future.

  2. The Electronic Services agreement may be terminated at any time by mutual agreement of the parties.

 

VI. COMPLAINTS PROCEDURE

  1. Procedure for complaints about the Electronic Services rendered by the Service Provider:

  1. Complaints about Electronic Services provided through the Gallery’s website should be submitted via email to lidiazdz@gmail.com

  2. All complaints should contain sufficient detail about the matter that is at issue. Specifically, complaints should include circumstances, the nature of the complaint, the date when the issue first arose as well as the complainant’s contact details. Providing all necessary data will speed up the complaint-handling process.

  3. All complaints shall be resolved promptly and in any event no later than within 14 days following the date of receipt.

  4. A response to the complaint shall be sent by email or other preferred method of contact indicated by the complainant.

 

VII. INTELLECTUAL PROPERTY

  1. The compilation of all content on the www.artlidia.pl website is the exclusive property of Lidia Zdzieszyńska, address for service: ul. Waszyngtona 98 m.63, 04-015 Warszawa, email address: lidiazdz@gmail.com, and is protected under copyright law. The Customer shall bear all liability for damages resulting from their use of the content of the website www.artlidia.pl without the consent of the Service Provider.

  2. Any use or reproduction of the content of the website www.artlidia.pl or any portion thereof without the express written consent of the Service Provider constitutes copyright infringement and is punishable under civil and criminal law.

 

VIII. FINAL PROVISIONS

  1. Agreements concluded through the website www.artlidia.pl are construed in accordance with the laws of Poland.

  2. Should any provision of these Terms and Conditions be prohibited by applicable law, the provisions of Polish law shall apply in lieu of the unenforceable provision.

  3. Any disputes arising between the Service Provider and the Customer shall be resolved in the first instance through out-of-court settlement procedures with a view to achieve amicable settlement of the disputes. Should such resort prove of no avail or unsatisfactory to any of the parties, disputes shall be resolved by a common court, in accordance with the provisions of the Code of Civil Procedure of 17 November 1964 (Dz. U. No. 43, item 296, as amended).
